JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-05-2019 Heard learned counsel for the petitioner, the State and the Life Insurance Corporation (in short 'the LIC'). It is submitted on behalf of the petitioner that the only grievance of the petitioner remains to be redressed is with regard to payment of GSLI claim of individual member amounting to Rs.5,34,526/- which, as per averments made in paragraph 6 of the counter affidavit filed by respondent nos. 4 and 5, is still pending as the said amount is lying in the account of the LIC of India due to non-submission of the petitioner's
Patna High Court CWJC No.1061 of 2017(3) dt.08-05-2019 2/3 bank account details as well as other necessary documents by the Zila Parishad, Gaya.
With reference to letters dated 6.7.2015 and 5.2.2019 (Annexures R/1 series to the counter affidavit filed by respondent nos. 4 and 5), learned counsel for the petitioner submits that in spite of repeated letters being written to the Deputy Development Commissioner cum Chief Executive Officer, Zila Parishad, Gaya ( respondent no.3) by the Manager (P & GS) Unit, Divisional Office, Patna, necessary documents required for crediting the aforesaid amount to the bank account of the petitioner, has not been furnished by the Zila Parishad, Gaya.
In compliance of order dated 28.11.2018, a counter affidavit has been filed by the LIC, whereas no counter affidavit has been filed by the Zila Parishad, Gaya addressing the petitioner's claim.
Considering the facts and circumstances of the case, the Deputy Development Commissioner cum Chief Executive Officer, Zila Parishad, Gaya (respondent no.3) is directed to furnish the petitioner's bank account details as well as other necessary documents to the LIC authorities within a period of four weeks from the date of receipt/production of a copy of this
Patna High Court CWJC No.1061 of 2017(3) dt.08-05-2019 3/3 order. Thereafter, the LIC authorities would take steps for settlement of GSLI claim of the petitioner within further four weeks from the date of submission of the required documents of the petitioner by respondent no.3.
Writ petition stands disposed of with the directions to the respondents as above.
