The petitioner is in custody in connection with Matihani P.S.Case No.10 of 2017 registered for an offence under Sections 447, 385, 386, 504 and 506/34 of the IPC and 27 of the Arms Act.

As per allegation, this petitioner, who is next door neighbour of the informant, came at his place and demanded ransom of Rs.1,00000/- and on refusal this petitioner shot fire which did not hit any one.

It has been submitted that the petitioner is next door neighbour of the informant and there is prevailing dispute for passage/street. On the date of occurrence, some quarrel had taken place between the children of both families. In the alleged

Patna High Court Cr.Misc. No.29413 of 2018 (3) dt.03-07-2018 2/2 occurrence, the informant has not sustained any injury. The petitioner is in custody since 29.12.2017 and so he deserves to be enlarged on bail.

The learned APP opposed the submission.

Considering the aforesaid facts and circumstances, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Javed Aslam, Judicial Magistrate, Ist Class, Begusarai in connection with Matihani P.S.Case No.10 of 2017 with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
