Anganbari Appeal Case No.01/2019 (Phul Kumari vs. The State and others) (Annexure-9) passed and issued by the District Magistrate, Bhojpur at Ara as well as its

Patna High Court CWJC No.17847 of 2021(2) dt.21-02-2024 2/3 consequential orders whereby and whereunder the appeal preferred by the Respondent No.8 has been allowed and the order dated 21.01.2019 passed by the District Programme Officer (ICDS), Bhojpur has been cancelled.

ii) For restoration of the order dated 21.01.2019 (Annexure-2) passed and issued by the District Programme Officer (ICDS), Bhojpur at Ara and issued vide its memo no.

124 dated 21.01.2019.

iii) For restoration of the services of the petitioner as Anganbari Sevika for Centre No.247 Ward No.10 under the Gram PanchayatUttarwari Jangal Mahal, Jagdishpur, Bhojpur, Ara with all consequential benefits of service.

iv) For a direction to the Respondents to restrain the Respondent No. 8 to work as Anganbari Sevika during pendency of this writ application.

v) For a direction to the Respondents to conduct enquiry and take appropriate action against the Respondent No.8 as well as the

Patna High Court CWJC No.17847 of 2021(2) dt.21-02-2024 3/3 other concerned authorities who are responsible for manipulation of the documents as well as facts."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, including that of filing a suit before the Ld. Civil Court having competent jurisdiction, for redressal of the aforesaid grievances. Liberty, so sought, is granted.

The writ petition stands dismissed as not pressed.
