The petitioner has filed the instant application for grant of regular bail in connection with Ara Nagar P.S. Case No. 209 of 2022 registered under Sections 363, 366(A) of the Indian Penal Code.

Prosecution case relates to abduction of the daughter of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this present case. The victim stated in her statement recorded under Section 164 of Cr.P.C. that she went to Delhi with him by her own sweet will and did not whisper any complicity of the petitioner in this case and also she

Patna High Court CR. MISC. No.50465 of 2022(3) dt.19-01-2023 2/2 wants to marry with the petitioner. The petitioner is not named in F.I.R. and during investigation his name came into light on the basis of mere suspicion. A statement has been made in para 3 of the petition that he has got no criminal antecedent. He is languishing in judicial custody since 13.06.2022. The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Ara Nagar P.S. Case No. 209 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Bhojpur at Ara.
