JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2015 At the outset, it is submitted that this application has already become infructuous so far as it relates to petitioner nos. 1 and 3 since they have been arrested.

Heard learned counsels for the petitioners and the State. The petitioner no. 2 is apprehending arrest in a case registered for the offences punishable under Sections 341,323,307,379 and 504/34 of the Indian Penal Code and sections 3 and 4 of the Prevention of Witch (Dyne) Practices Act. Specific accusation against the petitioner no. 2 is of assaulting Chhotan Singh. Injury report reflects only one injury which was found to be simple.

It is submitted by learned counsel for the petitioners that

Patna High Court Cr.Misc. No.31637 of 2014 (4) dt.04-02-2015 2/2 the petitioners are agnates of the informant side and statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent when there is counter version of the occurrence also.

Considering the aforesaid facts, let the above named petitioner no. 2 Sinod Singh @ Sinodh Singh be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Kutumba P.S. Case No. 22 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
