The petitioner seeks regular bail in connection with Semra PS case no. 68 of 2017 instituted for the offences punishable under Sections 302, 201 of Indian Penal Code. The case of the prosecution is that a dead body was found floating on the water which was discovered by the Chaukidar of the village and it was suspected that some unknown persons might have killed the girl and thrown the dead body in the canal.
The learned counsel for the petitioner submits that the petitioner is the brother of the victim girl and apart from suspicion, there is no material on record to connect the petitioner with the alleged crime. It is further submitted that the mother of
Patna High Court Cr.Misc. No.28515 of 2018 (2) dt.10-05-2018 2/2 the petitioner, similarly situated, has already been granted bail by this Court by an order dated 01.02.2018 passed in Cr.Misc. no. 4131 of 2018. It is further submitted that the petitioner is languishing in custody since 18.06.2017.
Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional District & Sessions Judge, Bagaha, West Champaran in connection with Semra PS case no. 68 of 2017. It is further directed that the petitioner shall appear before the learned trial court on each and every date so fixed by the trial and in default of two consecutive appearances, the present privilege of regular bail shall stand cancelled automatically.
