JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-01-2023 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Complaint Case No. 227 of 2019, registered for the offences punishable under Sections 341, 323, 379, 420, 504 and 120 B of the Indian Penal Code.

As per allegation, co-accused Surendra Kumar Patel executed a sale deed in respect of piece of land in favour of the

Patna High Court CR. MISC. No.50934 of 2022(2) dt.17-01-2023 2/2 complainant claiming it to be acquired by him from his maternal grandmother on the basis of a deed of will. Said Surendra Kumar Patel, concealed the fact that probate has not yet been granted. The allegation against the petitioner is that when the complainant went to complain, they assaulted her and snatched her ornaments and cash. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated merely because they are family members of co-accused Surendra Kumar Patel. They are the persons of clean antecedents.

Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned VI Judicial Magistrate 1st Class, Raxaul Motihari, East Champaran in connection with Complaint Case No. 227 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
