No. 49204 of 2019 filed by Ramdhani Paswan @ Ramadhin Paswan and in Cr. Misc. No. 56627 of 2019 filed by Munna Paswan @ Rambabu Paswan arising out of the same P.S. taken up together for disposal for the sake of convenience. The petitioners seek bail in a case registered for the offence punishable under Section 396 of the Indian Penal Code. The allegation of committing murder of the victim against the petitioners by gun shot fire.
Patna High Court CR. MISC. No.49204 of 2019(6) dt.03-02-2020 2/2 Learned counsel for the petitioners in both the cases have submitted that they have been made accused on the basis of confessional statement of co-accused, there is nothing against them. The petitioners in both the cases are in custody more than eight months but not put on T.I.P. They have got criminal antecedent i.e. Deepnagar P.S. Case No.14 of 2019 in which they are on bail. Chargesheet has been submitted as such there is no chance of tampering with the evidence.
Learned APP has converted the above submission as made. Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Nalanda P.S. Case No. 20 of 2019, subject to the condition is that the petitioners are directed to cooperate in the disposal of trial and appears as well when required, otherwise, their bail bonds shall be cancelled.
