The petitioner seeks bail in anticipation of his arrest in connection with Gaunaha P.S. Case No. 42 of 2020 dated 01.04.2020 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 354(B), 379, 504 and 506 of the Indian Penal Code.

The accusation against the petitioner is of assaulting the brother of the informant on his head. It has been urged on behalf of the petitioner that no weapon of assault has been specified and the victim has not received any injury on his head but on his hand, for which no opinion regarding its nature has been given up till now.

Patna High Court CR. MISC. No.6357 of 2021(3) dt.14-12-2021 2/2 A look at Annexure-2 of the bail petition discloses that the victim has suffered defused swelling in the right portion of his hand. The injury is said to have been caused by hard and blunt substance.

Considering the aforenoted facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Gaunaha P.S. Case No. 42 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
