JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-07-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 12.10.2017 passed in Cr.Misc.No.48346 of 2017 with direction to learned trial court to conclude the trial within a period of six months. Submission of learned counsel for the petitioner is that till date trial has not commenced and petitioner is in custody since 14.7.2017.
Heard learned APP and perused the report, from which it appears that due to non-production of the petitioner and nonappearance of other accused persons the trial could not be concluded.
Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail
Patna High Court Cr.Misc. No.30679 of 2018 (3) dt.04-07-2018 2/2 on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Muzaffarpur, in connection with Gaighat P.S.case No. 193 of 2016, on the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to appear before the trial court as and when required, otherwise his bail bond shall be cancelled.
