JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-04-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Hathauri P.S. Case No. 75 of 2015 registered under Sections 341, 323, 307, 504, 506 and 379/34 of the Indian Penal Code.

The accusation is that 5 persons named in the F.I.R. including the petitioners reached at the house of the informant armed with iron rod, farsa and knife and started to abuse him. In that course, they caused injury at the head of the informant and his younger brother Suresh Kumar Singh. In that course, they

Patna High Court Cr.Misc. No.9832 of 2016 (2) dt.20-04-2016 2/2 snatched gold chain from the neck of the informant and cash Rs. 2000/- was also snatched from his pocket of Vivek Kumar Singh. Learned counsel appearing on behalf of the petitioners submits that due to land dispute hot talks were exchanged in between the parties. It is also submitted that the informant, who is agnate, due to ulterior motive, lodged the present case. It is further submitted that the injuries as found on the person of Manoj Kumar, and his brother Suresh Kumar are simple in nature, which would appear from Annexure-2 of the petition.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Muzaffarpur in connection with Hathauri P.S. Case No. 75 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
