JUSTICE ARUN KUMAR ORAL ORDER 14-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 3.1.2018, seeks bail in Tiyar PS Case No. 72 of 2017 registered under Sections 302, 120B and 34 of the IPC.

The allegation in brief is that on the issue of irrigation of the field the accused persons quarreled with the informant and it is alleged that Nagendra Yadav killed his father by giving spear blow on his chest Learned Counsel for the petitioner submits that there is dispute between the family members, the allegation of killing father of the petitioner is against another co-accused one of the brothers Nagendra Yadav.

Having considered the fact that there is specific acusation of killing father of the informant against co-accused Nagendra Yadav and not against the petitioner, the petitioner, namely, Hareram Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bhojpur at Ara in connection with Tiyar PS Case No. 72 of 2017.
