The petitioners apprehend their arrest in a case registered under Section 307 and other sections of the Indian Penal Code.
Ash Md. Mian, the informant, named the petitioners along with others and alleged that while he was returning, all the five accused persons surrounded and began to assault him. Learned counsel for the petitioners submits that there is no specific allegations of assault against the petitioners. The doctor found the injuries simple on the person of the informant. The case has already been compromised. The petitioners have also filed a case against the informant.
It appears that there is litigation between the parties.
Patna High Court Cr.Misc. No.5813 of 2015 (2) dt.11-02-2015 2/2 There is omnibus and general allegations of assault. Injuries are simple in nature.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Raxaul at Motihari in Chauradano P.S. Case No. 30/2014, corresponding to G.R. Case No. 345/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
