JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-04-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Barhat Police Station Case No. 80 of 2015, disclosing offences under Sections 147, 148, 341, 323, 307, 379 and 504 of the Indian Penal Code.
From the First Information Report, it appears that the alleged occurrence took place over some land dispute between the parties. Allegedly, co-accused Ramphal Yadav assaulted the informant with farsha.
Learned Counsel for the petitioners submits that there is no specific allegation of assault against these petitioners. The petitioners have no criminal antecedent.
Patna High Court Cr.Misc. No.7896 of 2016 (2) dt.04-04-2016 2/2 Considering the submission, as above, this application is allowed.
Let the petitioners, namely, Mahendra Yadav, Wakil Yadav and Suresh Yadav, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar, Judicial Magistrate, 1st Class, Jamui, in connection with Barhat Police Station Case No. 80 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
