The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 117, 143, 147, 148, 149, 327, 387, 420, 467, 468, 471, 120B of the Indian Penal Code and 27 of the Arms Act.
The basis accusation is of transfer of the informant's land by petitioner no. 4 Most. Khairun Nesha in favour of petitioner nos. 1 to 3.
It is submitted by the learned counsel for the petitioners that the land is recorded in the revenue records in the name of petitioner no. 4. Sale deed was executed on
Patna High Court Cr.Misc. No.5578 of 2015 (2) dt.11-02-2015 03.04.2012 when the complaint was filed in 2013. Considering the accusation levelled in the background of dispute with regard to title of the land in question, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Dhaka (Pachhpakari) P.S. Case No. 128 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
