The petitioners apprehend their arrest in Khagaria P.S. Case No. 372 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. Hira Devi the informant named the petitioners purchased 10 kg. mango but did not pay the price on such altercation took place. Roshan Sahni is alleged to have assaulted Sanjay Sahni son of the informant with iron rod. Learned counsel for the petitioners submits that there is counter case bearing Khagaria P.S. Case No. 371 of 2014 in which Anandi Sahni is the informant. Sanjay Sahni received simple injury on account of assault made be Roshan Sahni. There is
Patna High Court Cr.Misc. No.8670 of 2015 (2) dt.04-03-2015 2/2 omnibus and general allegation of assault against all other accused persons. Anandi Sahni got grievous injury on his head. It appears that there is case and counter case and on account of purchasing mango and paying price the occurrence took place, but the son of the informant got simple injury whereas Anandi Sahni the informant of Khagaria P.S. Case No. 371 of 2014 got grievous injury.
Considering the facts aforesaid, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 372 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
