The petitioner, already in custody, seeks bail in connection with Special Case No. 54 of 2018 arising out of Malsalami P.S.Case No. 121 of 2018 registered under Sections 354D and 448 of the Indian penal Code and Sections 8 and 12 of the Protection of Children from Sexual Offence Act. Allegation in brief is that petitioner entered into the house of informant in the evening and tried to outrage the modesty of her daughter and he was also found in drunken condition. Submission is that petitioner has entered on account of some dispute regarding Rasta so he has been falsely implicated. Petitioner was apprehended on the same day but was not found in drunken state so no offence under the Excise Act was lodged against him and petitioner has clean antecedent. Having considered the aforesaid facts and circumstances,
Patna High Court Cr.Misc. No.28982 of 2018(2) dt.09-05-2018 2/2 the petitioner, namely , Rahul Kuamr @ Rahul Rai, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 1st cum Special Judge, POCSO, Patna in connection with Special Case No. 54 of 2018 arising out of Malsalami P.S. Case No. 121 of 2018 with condition that if he subsequently made accused in case of similar nature his bail bond shall be liable to be cancelled.
