Petitioner, already in custody, seeks bail in connection with Dhamdaha PS Case No.180 of 2017, giving rise to Sessions Trial No.333 of 2017, registered under Sections 376 and 511 of the Indian Penal Code.

Allegation in brief is that the petitioner trespassed in the night into the house of the prosecutrix and tried to remove her clothes and made an attempt of rape but on alarm raised by the prosecutrix, he hide himself under the cot and apprehended by the villagers.

Learned counsel for the petitioner submits that the informant is a married lady and allegation is of only removing the clothes, the petitioner is in custody since 29.07.2017, charge

Patna High Court Cr.Misc. No.28968 of 2018(2) dt.09-05-2018 2/2 has been framed against him, in fact he is a next door neighbour and has falsely been implicated.

Having considered the aforesaid facts and circumstances, petitioner Wakil Ram is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Purnea in connection with Dhamdaha P.S. Case No.180 of 2017, giving rise to Sessions Trial No.333 of 2017 with following conditions:

(1) One of the bailors must be the close family member of the petitioner.

(2) The petitioner shall remain physically present on each and every date before the trial court as and when required and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled. (Arun Kumar, J) S.KUMAR/- U T
