The petitioner apprehends his arrest in connection with Warisaliganj P.S. Case No. 177 of 2014 registered under Sections-307 & 379 & other minor sections of the Indian Penal Code.

Taking into consideration that the petitioner assaulted the informant's brother with butt of rifle, causing grievous injury on his head, I am not inclined to grant privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Warisaliganj P.S. Case No. 177 of 2014 pending in the court of Chief Judicial Magistrate, Nawada stands rejected.

However, if, the petitioner surrenders in the court below and seeks regular bail, this order shall not cause any

Patna High Court Cr.Misc. No.4682 of 2015 (2) dt.04-02-2015 2/2 prejudice to the learned court below at the time of consideration of regular bail application of the petitioner.
