JUSTICE ARUN KUMAR ORAL ORDER 09-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 5.3.2018, seeks bail in Kankarbagh PS Case No. 176 of 2018 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The allegation in brief is that the police apprehended the petitioner and others and from the possession of the petitioner one live cartridge is alleged to have been recovered. Learned Counsel for the petitioner submits that the recovery is of one cartridge, there is no thumb impression of the petitioner on the seizure list which creates doubt on the recovery, the petitioner has no criminal antecedent under the Arms Act but he has only antecedent under the Excise Act.

Having considered the said facts and circumstances, the petitioner, namely, Santu Verma is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Madhvi Singh, Judicial Magistrate, lst Class, Patna in connection with Kankarbagh PS Case No. 176 of 2018.
