JUSTICE VIKASH JAIN ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 09-03-2015 This Public Interest Litigation is filed alleging that respondent nos. 7 and 8 encroached a public road from Biharsharif to Ekangarwari in Village Govindpur Beldari, Police Station Noorsarai in the District of Nalanda. Though repeated representations are made to the Authorities of the Revenue and Police Department, they did not remove the encroachment.
This Court entertained this Public Interest Litigation and issued notice to the respondents, particularly the respondent nos.
Patna High Court CWJC No.13149 of 2014 dt.09-03-2015 2/2 7and 8. Respondent nos. 1 to 3 have filed counter affidavit. It is stated that encroachment of the road by respondent nos. 7 and 8 has been removed on 17.1.2015 with the intervention of the officials of the Revenue and Police Department. It is also stated that in the 'Panchnama' that was drawn on 17.1.2015, not only the officials but also the petitioner as also the respondent no. 8 have signed upon it. No reply affidavit has been filed contradicting the same.
We, therefore, close the Writ Petition since the grievance of the petitioner is redressed.
