JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 379, 448, 504, 427 and 307/34 of the Indian Penal Code. The accusation is of assaulting the informant and his mother with iron rod.
It is submitted by learned counsel for the petitioner that though, the injury of the informant has been found to be grievous whereas the injury of informant's mother has been found to be simple but the informant received only one injury whereas the accusation of assault is omnibus and general. The petitioners are the agnates of the informant and there is counter version of the occurrence also. The informant has subsequently retracted from his initial version and filed a petition to that effect before the
Patna High Court Cr.Misc. No.4585 of 2015 (2) dt.04-02-2015 2/2 learned court below.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Paraya P.S. Case No. 53 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
