This application has been filed under Article 227 of the Constitution of India against the order dated 18.01.2016 passed by learned Sub Judge 3rd, Patna in Execution Case No. 14 of 2014 whereby the court below rejected the application filed by the petitioner for time to bring stay order from the court who passed a decree in Miscellaneous Case No. 04 of 2015.

Perused the order.

Since the order passed by the court below is a reasoned order, and, therefore, I do not find any reason to interfere with the same in supervisory jurisdiction. Thus, this writ application is dismissed.

The petitioner may press the said application before the court where the Miscellaneous case is pending. Any observation made by this court or by the executing court shall not prejudice the court wherein Miscellaneous Case No. 04 of 2015 is pending for passing the order according to law.
