Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.
The petitioner seeks regular bail in connection with Sasaram Town P.S. Case No. 370 of 2022 lodged under Sections 30(a) of Bihar Prohibition and Excise Amendment Act, 2018. read with Sections 25(1-b)a, 26, 35 of the Arms Act. As per the prosecution case, the total recovery of 159 litre of wine, 2 pistol and live cartridges are the subject matter of the present case.
Learned counsel for the petitioner submits that petitioner's antecedent is clean. The said recovery has been made from the driving seat of the Hundai car. Learned counsel
Patna High Court CR. MISC. No.50799 of 2022(2) dt.25-11-2022 2/2 submits that he is neither owner nor driver of the said car. His name has figured in this case by secret information obtained by the police. Learned counsel further submits that petitioner is in custody since 30.05.2022 and charge sheet has already been filed in this case.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.2cum- Additional District and Sessions Judge, Rohtas at Sasaram in connection with Sasaram Town P.S. Case No. 370 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
