The petitioner apprehends his arrest in Pirpainty P.S. Case No. 239 of 2011 registered under Section 392 of the Indian Penal Code.
The cleaner of the truck bearing registration no. JH 04G-3196 alleged that many criminals came in a Bolero vehicle and, at the point of pistol, they took away his truck loaded with chips. The informant further alleged that his mobile no. 9661460778 was also looted away.
Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. Nothing has been recovered from the possession of the petitioner.
On perusal of the records, it appears that the
Patna High Court Cr.Misc. No.4895 of 2015 (2) dt.04-02-2015 2/2 petitioner was found talking with the looted mobile. The petitioner was apprehended but he managed to flee away from the custody of the police.
On considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Pirpainti P.S. Case No. 239 of 2011. Accordingly, the same is rejected. The petitioner is directed to surrender in the court below within four weeks from today in connection with the aforesaid case and make prayer for regular bail. The court below shall consider the prayer for regular bail of the petitioner on its own merit, without being prejudiced by the present order. (Prabhat Kumar Jha, J) Dilip/- U T
