JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2016 The present application has been filed for modification of the order dated 12.10.2015 passed in Cr. Misc. No. 40928 of 2015 for extending the period of deposit of 20% of the alleged due amount.

The petitioner was granted provisional anticipatory bail for a period of four months in connection with Chenari P.S. Case No. 61 of 2015 registered under Sections 406 and 420 of the IPC on the undertaking that he will deposit 20% of the alleged due amount of `24,77,780.10/- within a period of three months but the same could not be deposited and since the provisional bail was to be confirmed by the learned court below on deposit of 20% of the alleged due amount, the same was not confirmed. It is submitted by learned counsel for the petitioner that now the petitioner has already deposited 20% of the alleged due amount and this fact has not been controverted by Ms. Jyotsana

Patna High Court Cr.Misc. No.8613 of 2016 (3) dt.02-03-2016 2/2 Kumari learned counsel for the Bihar State Food and Civil Supplies Corporation Ltd. It is further submitted that the bail bonds of the petitioner have not been cancelled as yet. In the circumstances, the period of provisional bail is extended up to 15th of April, 2016.

Let the learned court below confirm the provisional bail of the petitioner after verification of the fact that 20% of the alleged due amount has already been deposit by the petitioner. The learned court below is expected to do the above exercise within a period of four weeks.

The order dated 12.10.2015 passed in Cr. Misc. No. 40928 of 2015 is modified to the extent as indicated above. Accordingly, the modification application is disposed of.
