JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 05-08-2015 The writ application has been filed for the following relief(s) as culled out in paragraph 1:- "That the present application is being filed for issuance of writ, order or orders or direction to the respondents authorities for add or amend in the name and style of School before Rajkiya Madhayamik Vidyalay, Chand Surari as "Raghuwar Narain Rajkiya Madhya Vidyalay, Chand Surari" under P.S and Block Bibhutipur, District-Samastipur as it was in original status. Otherwise respondent s be directed to vacate the land and aforesaid school's premises as per terms and conditions of deed of agreement."
Patna High Court CWJC No.18171 of 2010 (4) dt.05-08-2015 2/2 In the counter affidavit it has been stated that such prayer of the petitioner is not acceptable inasmuch as there is no document to show that the name and style of the School was Raghuwar Narain Madhymik Vidyalaya, Chand Surari prior to its take over in the year 1971.
Any dispute of this nature, particularly in view of the stand taken in the counter affidavit, cannot be gone into in extraordinary and discretionary writ jurisdiction of this Court. It is open to the petitioner to seek other remedy as provided under law. The writ application is dismissed.
