JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 353, 34 of the Indian Penal Code.
The prosecution case is that the informant being Sub-Inspector, Excise went to raid the house of the informant on getting information about manufacturing and selling the illicit liquor when the petitioner and his family members abused and assaulted the informant and others. It is submitted by learned counsel for the petitioner that raid was laid only on suspicion and when nothing was recovered from the house of the petitioner, hence malicious accusation has been levelled. There is nothing on record to suggest that any misbehavior was made to the informant and others or any injury was caused to the informant.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Benipatti, Madhubani in connection with Saharghat P.S.
