The petitioner seeks bail in Sessions Trial No.197 of 2018 arising out of Saraiya P.S. case No.233 of 2017 registered under Sections 302, 201, 120(B)/34 of the Indian Penal Code, pending in the court of A.D.J. XIIIth, Muzaffarpur. Allegation is that the petitioner committed murder of informant's husband, namely, Nandlal Sahani and also committed murder of her father-in-law, namely, Bishundeo Sahani.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.06.2017 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has
Patna High Court CR. MISC. No.48082 of 2019(3) dt.27-09-2019 2/2 falsely been implicated in the present case. There was admitted land dispute. For the said reason, the present case has been instituted.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R. He is alleged to have given knife blow upon the deceased and his father.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected.
The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of nine months from the date of receipt/production of a copy of this order. (Sudhir Singh, J) Narendra/- U T
