Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act. This is a case of misuse of privilege of bail for one year.

Submission is that petitioner is in custody since last three months. Petitioner had not committed any misuse in the past and petitioner undertakes that he will not commit misuse in this case in future.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.49961 of 2019(2) dt.09-08-2019 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with S.Tr. No.377B of 2017, arising out of G.B.Nagar Police Station Case No.196 of 2016, subject to following conditions:- (I) That if the petitioner would commit further misuse that would be a ground to conclude the trial after keeping the petitioner in custody.

(ii) That both the bailors shall be resident of the territorial jurisdiction of the learned court below. (iii) That the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
