JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

100 liters of kerosene oil was recovered from the house of petitioner and it was suspected that it was being kept for black marketing.

It is submitted by the learned counsel for the petitioner that there is nothing on record to suggest that the recovered kerosene oil was kept for black marketing, petitioner is not a P.D.S. dealer and recovery was made from the courtyard of house of the petitioner.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or

Patna High Court Cr.Misc. No.7424 of 2016 (2) dt.19-02-2016 2/2 surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Munger in connection with Bariyarpur P.S. Case No. 3 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
