The petitioners Nos.1, Ramun Nat, 2. Suni Nat, 3. Tetari Devi and 5. Rekha Devi apprehend their arrest in Bihiya (Town) P.S. case No. 323 of 2015 (G.R. case No. 5286 of 2015) under Section 366, 498, 494, 34 of the Indian Penal Code. Surendra Nat, the informant, filed a complaint case on the basis of which the present FIR is lodged. The informant alleged that he was married with Manita Devi in the year 2012 but his wife went to her parents and the accused persons, who are parents and relatives of Manita Devi, sold Manita Devi to Antu Nat.
The learned counsel for the petitioners submits that petitioners never sold Manita Devi to Antu Nat. In fact Manita
Patna High Court Cr.Misc. No.8718 of 2016 (4) dt.30-08-2016 2/2 Devi was married in the year 2010 with Antu Nat and she got children. Notice was issued to Manita Devi and Surendra Nat and Manita Devi appeared but Surendra Nat did not appear. The learned counsel for the Manita Devi also submitted that Manita Devi was married to Antu Nat and she was never married to Surendra Nat.
Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners Nos. 1 to 3 and 5, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in Bihiya Town P.S. Case No. 323 of 2015 (G.R. case No. 5286 of 2015), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
