The petitioner apprehends his arrest in connection with Alipur P.S. Case no. 59 of 2017, registered under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code. The accusation is that due to illegal withdrawal of money under Indira Awash Yojana, Alipur P.S. Case No. 59 of 2017 is instituted on 03.10.2017 under Sections 419, 420, 467, 468 and 471 of the I.P.C. against seven persons named in the F.I.R.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner come in the confessional statement of Bindeshwari Devi, who has confessed about receiving the
Patna High Court CR. MISC. No.46806 of 2019(2) dt.29-07-2019 2/2 money under Indira Awash Yojana and she also stated that this petitioner was her identifier, except, that nothing has been collected by the I.O against the petitioner. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-II, Gaya in connection with Alipur P.S. Case No. 59 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
