2. The petitioner is in custody in connection with Gaurichak P.S. Case No. 714 of 2024 for the offence punishable under sections 80(2) and 61(2)(a) of the Bharatiya Nyaya Sanhita and section 3 and 4 of the Dowry Prohibition Act, lodged on 29.11.2024 by the informant, Aarti Devi.

3. As per the prosecution story, the informant alleged that the deceased was married to Chandrabhan Singh, they used to stay in Delhi but was tortured for dowry and later, the killing took place which led to the F.I.R.

4. Learned counsel for the petitioner submits that they were living happily, had two children, on the eve of Chhath Puja

No.50187 of 2025(2) dt.11-08-2025 2/3 they were visiting the native place and in a spur of moment, it seems that the lady committed suicide but the allegation of killing has come. He has taken this Court to learned Sessions Judge order to show that the cause of death has been recorded as asphyxia due to hanging.

5. Learned APP opposes the prayer for bail submitting that allegation of demand of motorcycle is there.

Taking into account the aforesaid facts as also the cause of death which has been recorded in the learned Sessions Judge order, petitioner is in custody since 16.12.2024, has two children to take care of, has no criminal antecedent, in that background, this Court is inclined to extend him the privilege of bail.

7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Patna City, Patna, in connection with Gaurichak P.S. Case No. 714 of 2024 subject to the following conditions:

(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;

Patna High Court CR. MISC. No.50187 of 2025(2) dt.11-08-2025 3/3 (ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) vinayak/- U T
