The petitioner seeks bail in Murar P.S. Case No. 21 of 2018 registered for the offence punishable under Section 30(a) of the Bihar Excise & Prohibition Act, 2016. Informant who is A.S.I. in his written report has alleged that he was on patrolling duty on 10.04.2018 and when he reached near village Thori Pandeypur at about 7:30 pm, he received secret information that one Pickup Van No. BR03K3191 coming from Koransarai is loaded with illicit liquor. At about 8:10 pm the said Pickup Van came and the informant along with other police personnel during the course of checking of the said vehicle three cartons of Foreign Wine in which 79 pieces of 180ml with label of Bombay Special Whisky and 48

Patna High Court Cr.Misc. No.30187 of 2018(2) dt.16-05-2018 2/2 pieces of 180ml with label of N.V. Group Punjab Excise Premium Liquors were recovered.

It has been submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner rather the alleged recovery has been made from the Pickup Van. It has been further submitted that petitioner is the only driver of the vehicle. Petitioner has got no criminal antecedent and is in custody since 11.04.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J-II cum Special Judge, Excise Act, Buxar in connection with Murar P.S. Case No. 21 of 2018.
