JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Turkauliya (Raghunathpur) P.S. Case No. 289 of 2019, disclosing offence under Section 420 of IPC. F.I.R. disclosed an allegation that there was a talk between the co-accused Naresh Kumar Verma and complainantinformant with respect to sale of 06 Katha 14 Dhurs of land of the informant on consideration money of Rs. 40,00,000/- in order to encroach the passage. It is also alleged that in the presence of the petitioner, said Naresh Kumar Verma had given the advance money of Rs.14,00,000/-. Thereafter, started using the passage, but has not paid the rest of the amount and he has started selling the land also.
Submission of the learned counsel for the petitioner is that except the allegation that he was also present at the time of
Patna High Court CR. MISC. No.47383 of 2019(2) dt.30-07-2019 2/2 payment of advance of the consideration money, there is nothing against him.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Turkauliya (Raghunathpur) P.S. Case No. 289 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
