2. This is the second attempt of the petitioner for grant of regular bail in connection with Sessions Trial No. 792 of 2023 arising out of Garkha P.S. Case No. 220 of 2022 registered for the offences under Sections 328, 304B/34 of the Indian Penal Code.

3. The petitioner is in jail since 21.04.2022.

4. From the report of the trial Court, it appears that charge was framed on 20.01.2024 but no witness has been examined till date and there are five charge-sheeted witnesses including the doctor and the investigating officer.

5. Considering the delay in the trial and also considering the period of custody, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, VIII, Saran at Chapra/ concerned Court below in connection with Sessions Trial No. 792 of 2023 arising out of Garkha P.S.
