The petitioner has renewed his prayer for anticipatory bail in a case registered for the offences punishable under Sections 376/511 of the Indian Penal Code. Though, on conclusion of the investigation final report was submitted under Sections 457 and 354 of the Indian Penal Code and consequently cognizance was taken under the said provisions. It is submitted by learned counsel for the petitioner that earlier the petitioner preferred anticipatory bail vide Cr. Misc. No. 26062 of 2015 but the same was permitted to be withdrawn since it was submitted that the petitioner was on police bail but, in fact, the petitioner was not on police bail.

Patna High Court Cr.Misc. No.7967 of 2016 (2) dt.27-07-2016 Considering the fact that earlier anticipatory bail application of the petitioner was permitted to be withdrawn vide order dated 02.07.2015 and the present application has been preferred on 16.02.2016, this Court is not inclined to revise the earlier order.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Mohania P.S. Case No. 169 of 2015 pending in the court of learned Sub-divisional Judicial Magistrate, Kaimur at Bhabua.
