The present writ petition has been preferred for the grant of following relief/s:- "That this is an application for issuance of a writ in the nature of Mandamus and/or any other appropriate writ/writs for commanding and directing the respondents to accord permission for construction of building of upgraded middle school, Janaro on Khata No.- 166, Khesra

Patna High Court CWJC No.2068 of 2017(3) dt.07-10-2024 2/3 No. 360, area 65 dismal and to construct a building over the same in view of the decision/resolution so taken in the meeting dated 30.08.2016 by 'Gram Sabha', which was so held pursuant to the letter No. 314 dated 28.03.2016 by the Block Development Officer, Ben, Nalanda and/or may an such any order/orders, direction/directions for which the petitioner may be found legally entitled too."

3. If what has been contended in the writ petition is correct, it is unfortunate that the children of the area are not having a proper educational institution. The matter is lingering since last eight years without any positive result. The children are the future of this Country and they cannot compete with the other similar situate children, if proper infrastructure is not available.

4. If the situation is the same as when the writ petition was filed, it is high time that the respondent no. 2, the District Magistrate, Nalanda at Biharshariff takes a decision and the time frame is maintained so that the children picks up the thread by 1st of April, 2025 i.e., the next educational session.

5. Learned counsel for the petitioner shall be submitting a proper petition along with all the relevant documents within four weeks before the respondent no. 2, the District Magistrate, Nalanda, Biharshariff with a copy of it to the respondent no. 1, the Additional Chief Secretary, Education Department, Bihar, Patna.

6. If such petition is filed, the respondent no. 2 is duty bound to take a decision and ensure that a proper institution comes into place and till then, a Government Building should be allotted to the said Middle School, Janaro, Nalanda so that the children could study properly.

7. All the exercise has to be completed by 31st of March, 2025.
