The petitioner apprehends his arrest in Bihariganj P.S. Case No. 169 of 2014, registered for the offences punishable under Section 353 and other Sections of the Indian Penal Code. According to the prosecution case, the police reached at the spot on getting information that a woman died during the course of treatment, on such many villagers came there, tried to protest and assaulted the informant and pelted stones. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and no specific allegation is made against him.

Considering the facts and nature of allegation made against the petitioner, he, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.5340 of 2015 (2) dt.09-02-2015 before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Pradip Kumar Choudhary, the learned Judicial Magistrate, Udakishunganj, Madhepura in connection with Bihariganj P.S. Case No. 169 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
