The petitioners seek bail in connection with Banka P.S. Case No. 499 of 2020 instituted for the offences under Sections 341, 342, 302 and 34 of the Indian Penal Code read with Section 7(C) of the Protection from Lynching Act, 2017. Learned counsel for the petitioners submits that the petitioners are in custody since 12.08.2021, are persons with clean antecedent and charge-sheet has been submitted in the case.
Learned counsel for the petitioners submits that the petitioners along with other accused tied the son of the
Patna High Court CR. MISC. No.60216 of 2021(3) dt.10-03-2022 2/2 informant in the house of Kishundeo Yadav with rope and brutally assaulted him due to which he died on the spot. Learned counsel for the petitioners submits that the petitioners have been falsely implicated and co-accused Kishundeo Yadav and Lalita Devi have been granted bail vide order dated 27.08.2021 passed in Cr. Misc. No. 6295 of 2021. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioners.
Considering the fact that the petitioners are in custody, charge-sheet has been submitted in the case, the petitioners are persons with clean antecedent, allegation of assault is general and omnibus in nature and the co-accused have been granted bail, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/Successor Court, Banka in connection with Banka P.S. Case No. 499 of 2020.
