Sinha, learned Counsel, appearing on behalf of the petitioner, and Mr. Anjani Kumar, learned Additional Advocate General No.6, appearing on behalf of the State-respondents.
In view of the fact that the counter affidavit has been filed by the respondents on the basis of the report submitted by the Principal of the school, in question, that no land of the school, in question, has been encroached upon, it becomes clear that this Public Interest Litigation raises disputed questions of fact, which cannot be determined in a proceeding of present nature.
In view of the above and in the interest of justice, this Public Interest Litigation is closed with liberty given to the petitioner to take recourse to such provisions of law as may be permissible including institution of a suit in a civil court of competent jurisdiction.
