In view of the fact that the property has already been auction sold by the concerned Gramin Bank under section 13(4) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002(hereinafter to be referred to as "the Act"), the petitioner submits that this application has become infructuous and seeks withdrawal of the same to pursue the matter before the Debt Recovery Tribunal under section 17 of the Act.
Patna High Court CWJC No.2342 of 2015 (2) dt.06-02-2015 Accordingly, this writ application is dismissed as withdrawn with the aforesaid liberty granted to the petitioner.
