The petitioner apprehends his arrest in connection with Dumariya P.S. Case no. 15 of 2016, registered under Section 409/34 of the Indian Penal Code.

The accusation is that in spite of giving directions to the Secretaries of Dumariya Panchayat, including the Chakarbandha Panchayat, the file and folder etc. has not been submitted regarding the appointment of Panchayat Teachers from 2003-04 to 2015-16.

Learned counsel for the petitioner submits that petitioner being the Secretary of Chakarbandha Panchayat of block dumariya, District-Gaya had already submitted the file

Patna High Court CR. MISC. No.46804 of 2019(2) dt.29-07-2019 2/2 and folder of Merit-list, roster register and selection register along with the application regarding the appointment of Panchayat teacher of 2003-04 to 2015-16 on 24.01.2016 to B.R.C. Dumaria, Gaya, which would appear from Annexure-2, but with ulterior motive, the petitioner being the Secretary of Chakarbandha Panchayat has falsely been implicated in this case. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Sherghati, Gaya in connection with Dumariya P.S. Case no. 15 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
