Mr.Md. Sufiyan, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-01-2023 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends her arrest in connection with Begusarai Nagar (Lohiya Nagar O.P.) P.S. Case No. 147 of 2022, registered for the offences punishable under Sections 341, 323, 224, 225, 353, 385, 387/34 of the Indian Penal Code and also under Section 25(1-b)a/26 of the Arms Act. As per allegation, the husband of the petitioner was demanding ransom from one Shubham Kumar. He was arrested by the police. As per allegation, the petitioner, who is wife of Kumar Priyadarshi, misbehaved with the police party. It has also been alleged that a country made pistol was recovered from the house of the accused persons.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.50609 of 2022(2) dt.17-01-2023 2/2 that the petitioner is a lady. She has no criminal antecedent and has falsely been implicated in this case merely because she is protesting the misbehavior of the police party towards her husband.

On the other hand, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of her arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Nagar (Lohiya Nagar O.P.) P.S. Case No. 147 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
