The petitioners seek bail in anticipation of their arrest in connection with Nawada P.S. Case No. 417 of 2020 dated 12.05.2020 instituted for the offences under Sections 341, 323, 325, 308, 379, 504, 506 and 34 of the Indian Penal Code.
The accusation in the FIR is of the accused persons assaulting the informant and another. The specific accusation of assault is on one Dharmendra Yadav and Shiv Yadav and not on the petitioners. The
Patna High Court CR. MISC. No.5887 of 2021(2) dt.02-11-2021 2/2 accusation against them is of general and omnibus nature. The informant and another have received simple injuries.
Regard being had to the background facts and the nature of accusation, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada P.S. Case No. 417 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
