The petitioners apprehend their arrest in Uchakaganon P.S. Case No. 184 of 2014, registered for the offences punishable under Sections 304B and 201 of the Indian Penal Code.
The informant alleged that the accused persons killed his daughter Pushpa Devi.
Learned counsel for the petitioners submits that the victim is still alive. From the side of the petitioners a case was
Patna High Court Cr.Misc. No.5506 of 2015 (2) dt.10-02-2015 lodged immediately after institution of the present case. Pushpa Devi was missing from the house. Pushpa Devi was recovered and she made her statement under Section 164 of the Cr.P.C. and disclosed that she had quarrel with her mother-in-law and sisterin-law that is why she had left her house. An old lady took her in her house and she was not allowing her to come. She did not make any allegations against the petitioners.
Considering the facts aforesaid and the fact that the victim is recovered and she did not make any allegation of demand of dowry and torture against the petitioners, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri A.K. Mall, the learned Judicial Magistrate 1st Class, Gopalganj in connection with Uchakaganon P.S. Case No. 184 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
