The petitioner is in custody since 21.11.2018 in connection with Kotwali (Basudeopur) P.S. Case No. 333 of 2017 for the offence registered under Sections 364/34 of the Indian Penal Code later on 302/201 of the Indian Penal Code. . Learned counsel for the petitioner submits that the petitioner has been taken into custody on mere suspicion and he has been named in the first information report. It is further submitted that there is no material to show that no one has seen the petitioner with the deceased. It is further submitted that similarly situated co-accused person, namely, Ram Chandra Yadav has been granted bail by this Court vide order dated 27.04.2018 passed in Cr. Misc. 25444 of 2018. It is further submitted that another coaccused, namely, Aashish Kumar, who has been similarly named in the First Information Report, was released on bail vide order
Patna High Court Cr.Misc. No.29747 of 2018 (2) dt.18-05-2018 dated 16.04.2018 passed in Cr. Misc. No. 20548 of 2018. Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Kotwali (Basudeopur) P.S. Case No. 333 of 2017.
