The petitioner has prayed for bail in a case instituted for the offence under Sections 144, 149, 447, 594, 341, 323, 324, 307, 509, 325, 354(B), 379, 380 of the Indian Penal Code. As per allegation in the FIR, petitioners along with 15-16 other co-accused persons, variously armed, entered into the house of the informant and started to abuse and assault his family members. Specific allegation against petitioner Bhogendra Yadav is of assaulting causing fracture on his left

Patna High Court CR. MISC. No.50324 of 2022(3) dt.16-01-2023 2/2 hand and allegation against the petitioner is of assaulting on the head of victim Anandi Yadav by means of Farsa causing cut injury.

It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case due to land dispute. There is case and counter case. Members of both parties have sustained injuries as alleged in separate incident. Both petitioners have been languishing in judicial custody for about six months.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Supaul in connection with Triveniganj P.S. Case No. 263 of 2021.
