The petitioner is apprehending his arrest in connection with Complaint Case No.137 of 2018 registered for offences punishable under Sections 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
As per the allegation the informant has been ousted from the house with respect to demand of Rs.50,000/-. Submission of the learned counsel for the petitioner is that no such marriage has been solemnized with the complainant and he has been falsely implicated in this this. On the other hand learned counsel for the O.P. No.2 has opposed this application on the ground that they have a child also from
Patna High Court CR. MISC. No.46368 of 2019(4) dt.22-10-2019 2/2 the marriage and the complainant has been ousted from the matrimonial house.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may surrender and pray for regular bail. iWith the aforesaid direction, this application is dismissed.
